The web site www.batanga.com and its mobile applications (”the Web site”) are provided by Batanga, Inc. (”Batanga”). By using the Web site you consent to the use of your Personal Data (defined below) as described in this Privacy Policy (”Policy”). If you are unwilling to accept the terms of the Policy and those in the Terms of Use and Code of Conduct you should not access the Web site nor install its mobile applications. Your privacy is important to Batanga. This Policy will help you understand how and the extent to which Batanga collects, uses and safeguards the Personal Data you provide at the Web site. Users are under no obligation to provide any Personal Data. If, however, you opt not provide certain Personal Data, you might not be eligible to participate in certain areas of the Web site.

Collection and Use of Personal Data and Information

When you visit the Web site, you provide us with both Personal Data, which you knowingly choose to disclose, and anonymous Web site use information that we collect as you interact with the Web site.

Personal Data

The term “Personal Data” means personally identifiable information that you provide to Batanga about you, including, but not limited, to your first and last name, postal code, country of preference, date of birth, gender and e-mail address. Batanga obtains your Personal Data directly from you via registration, online surveys or from other transactions you may have with Batanga or its affiliates.

In order to sign up to use the personalized portions of the Web site, you must provide at least your email address and additionally you could provide your birth date and gender.

Batanga at times collects, retains and utilizes Personal Data about you to perform market analysis and to compile and disseminate reports to third parties comprised of aggregated data that does not identify individuals.

When you use the Web site, you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, add applications, and transmit information through various Web site features. We collect this information so that we can provide an interactive service and offer personalized features. For instance, as a result of your entering Personal Data you can return to view prior messages you have sent or easily see your friends list. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable us to refer to the prior version of that information.

Anonymous Web site Use Information

As you interact with the Web site, we automatically collect information that does not personally identify you, such as your type of Internet browser or computer operating system, the domain name of a linking web site to or from the Web site, location (e.g. Country, State, City) and IP addresses (i.e., the number that is automatically assigned to a computer for Internet usage)

We also store certain information from your browser using “cookies.” A cookie is a piece of data stored on the user’s computer tied to information about the user. We use session ID cookies to confirm that users are logged in. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you visit the Web site in the future. In addition, when a user views one of our Web site advertisements, we may store some information on that user’s computer. Cookies allow for tailoring the Web site and its advertisements to better match users’ interests and preferences. Batanga does not collect Personal Data automatically, but may tie information that does not identify you (that is collected automatically, like your favorite radio station) to previously submitted Personal Data (like your email address) to send you music recommendations via email.

Ad Serving and Third Party Ads and Data Services

The ads appearing on Batanga.com are delivered to you by DoubleClick and Collective Media, our Web advertising serving partners. Information about your visit to this site, such as number of times you have viewed an ad, is used to serve ads to you on this site. And, in the course of serving advertisements to this site, third party advertisers may place or recognize a unique cookie on your browser. Some of the advertisements and other services that appear on our web site(s) are delivered to you by Internet advertising and data collection companies. User Submissions

You post User Submissions (as defined in and governed by the Batanga Terms of Use Agreement) on the Web site at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Submissions you post on the Web site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Web site. You understand and acknowledge that, even after removal, copies of User Submissions may remain viewable in cached and archived pages or if other Users have copied or stored your User Submissions.

Any improper collection or misuse of information provided on the Web site is a violation of the Batanga Terms of Use and Code of Conduct and should be reported to privacy@batanga.com.

Friend Invitation Feature If you choose to use our invitation service to tell a friend about our site, we will ask you for your friend’s contact information, including email address. We will automatically send your friend a one-time email or instant message inviting him or her to visit the Web site. Batanga keeps this information for purposes of sending this one-time invitation, to register a friend connection if your invitation is accepted, and to track the success of our referral program. Your friend may contact us at privacy@batanga.com to request that we remove this information from our database.

Use of Personal Data

We use your Personal Data to send you service-related messages and notifications, including among others, notifications about changes and upgrades to the Web site, new Batanga services, new releases, recommendations of music and radio stations, notifications about new music added to your stations and messages to learn about what you want us to put on the Web site. Batanga may store and process Personal Data to better understand its users.

If you register in the Web site you create your own profile and privacy settings. Your profile information, as well as your name, email and photo (if you submit it), are displayed to people in the networks to enable you to connect with people on the Web site. We may occasionally use your name and email address to send you notifications regarding new services offered by Batanga that we think you may find useful or entertaining

Batanga presents your Personal Data to others who are permitted to view that information according to your privacy settings. Your name and profile picture (if you submit one) will be available in search results across the Web site network and those limited pieces of information may be made available to third-party search engines. Batanga may send you service-related announcements from time to time through the general operation of the service.

Batanga may also use Personal Data to send you special offers we think you will find valuable. You may opt out of such special offers here, though Batanga reserves the right to send you service-related messages and notifications even if you have opted out of receiving special offers that are not service-related.

Batanga may disclose information from your profile that does not identify you to third parties. We do this for purposes such as aggregating information about how many people in a network like a given band or video and for purposes of personalizing advertisements. For example, if you put a favorite song in your profile, we might serve you an advertisement highlighting the release of a new recording featuring similar music. We do not share your Personal Data with third parties, such as the record company in this example.

Batanga collects information when you use Web site services such as the Radio Player and when you take certain actions like rating songs, artists, and videos. We keep track of your settings and ratings for several reasons, including to better understand your music preferences, to customize certain content, to recommend music to purchase or play, and to provide our services.

Linking your Web site account with accounts of other Services

Batanga may offer the option to link your Web site account with other services accounts such as: Facebook.

By linking your account and explicitly giving access to the Web site over your other service’s account through that service authorization mechanism, you consent to the use of that service to send you notifications and messages service-related, which may be visible to others subject to the privacy settings of the other service, which are beyond Batanga’s control. The Web site could allow you to turn off some of those notifications. Also, you consent to use your personal information available on the other service as part of your personal information provided to Batanga.

You could at any time retire the Web site access over your other service’s account using the other service authorization mechanism or by writing to us here.

Disclosure of Personal Data

Batanga does not sell, trade, rent or otherwise disclose your Personal Data to others other than as stated in this policy without your written or electronically indicated consent. Batanga will disclose your Personal Data to third parties for marketing purposes where: (1) you specifically indicate that you would like to receive more information about certain products or topics of interest by selecting the checkbox on various forms, or (2) you provide your Personal Data as part of sponsored “giveaway” promotion offered at the Web site. Batanga is not in control of or responsible for the use and disclosure of your Personal Data by these third parties, should you choose to provide your Personal Data to them.

From time to time, Batanga and/or its business partners may sponsor a promotion, sweepstake or contest on the Web site. Users may be asked to provide Personal Data including name, email address or home address or to answer questions in order to participate. Batanga may transfer such Personal Data to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the Personal Data and whose privacy statement will apply.

Batanga shares Personal Data with its agents or contractors for non-marketing purposes, but only in connection with services that these individuals or entities perform for Batanga. For example, a third party may have access to your Personal Data in order to support our information technology needs or help compile and manage the data. All Batanga contractors operate under federal and state laws regarding consumer privacy.

Batanga may, in its sole discretion, share or transfer your Personal Data where permitted or required by law, to comply with legal processes (for example, Batanga may disclose your Personal Data as necessary to comply with an authorized civil, criminal or regulatory investigation), to protect the security or integrity of its databases or the Web site, to protect Batanga’s business or reputation, to take precautions against legal liability, in the event of a business transition (see below), to protect and defend its rights or property, for required institutional risk control, or for resolving disputes, inquiries or complaints with respect to your use of the Web site.

Your Consent to Transfer, Collection and Use of Personal Data

By using the Webs site, you are consenting to have your Personal Data transferred to and processed in the United States.

Changing or Deleting your Personal Data

If you create a Web site account and in doing so submit Personal Data through the Web site and would like to correct or delete that Personal Data, you can change your Personal Data by accessing your account profile. The Personal Data in your profile is available to you for editing each time you access the Community area of the Web site. You can request to cancel or close down your account by requesting so to feedback@batanga.com. Deleted Personal Data will be stored by Batanga, but will not be available to Batanga members. When you share information with others at the Web site, however, (e.g., sending a personal message to another user) such communications can generally not be removed.

If you would rather not receive promotional emails from Batanga, please send an email to privacy@batanga.com. You can alternatively send a hard copy letter to: Privacy Compliance Coordinator, 2121 Ponce de Leon Blvd., Suite 800, Coral Gables, FL 33134. Make sure to list each e-mail address you have registered with us. Your email address will then be removed from the promotional email database as soon as practically possible.

Batanga is a free online community, allowing members to post content and information. As stated in the Terms of Use, Batanga takes no responsibly for any misuse or abuse that may be carried out by other members, including misuse of information that you volunteer in the course of participating at the site. If you find offensive material or think that someone is taking advantage of your identity, please contact us.

Links

Users should know that while visiting the Web site, they can be directed, through links, to other web sites that are beyond Batanga’s control. Batanga is not responsible for the privacy practices and policies of the web sites found at the websites linked to at the Web site.

Protection of Personal Data

Batanga is committed to keeping Personal Data secure and will take all reasonable physical, electronic and procedural precautions to protect Personal Data from unauthorized access, loss, misuse or alteration. Agents or contractors providing services to or for Batanga that may have access to Personal Data submitted by users of the Web site (as explained above) are required to keep Personal Data confidential and are not permitted to use Personal Data for any other purpose than to carry out the services they are performing for Batanga.

Batanga keeps your Personal Data only for as long as reasonably necessary for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements. Minors

Batanga does not knowingly collect any Personal Data from children or individuals under 13 years of age. Where appropriate, Batanga will specifically instruct any person under age 13 not to submit such information on the Web site. If you are under 13, please do not attempt to register with Batanga or send any information about yourself to us, including your name, address, telephone number, or email address. Upon discovery that a minor has provided Batanga with Personal Data, that minor’s information will be removed from the Batanga’s databases as soon as practically possible. We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.

Business Transitions

In the event Batanga goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Data might be among the assets transferred.

Changes in Policy

If Batanga decides to change this Policy it will post the changes at the Web site and at other places it deems appropriate so that you are aware of what information it collects, how it uses it, and under what circumstances, if any, it discloses it. Batanga reserves the right to modify this Policy at any time, so please review it frequently.
